and it is happening tonight in east san jose where a stranger tried to take a toddler from his mother's arms. good evening, everyone. i'm carolyn johnson. >> i'm dan ashley. the mother is scared, but the toddler is okay. it happened in east san jose. thomas roman is there live to explain exactly what happened. thomas? >> dan, we spoke to the child's father who told us he is not going to comment.

he will let san jose police deal with this attempted kidnapping. the mother basically had a tug of war with this suspect in order to save her child. san jose police received a call at 5:37. according to police the two-year-old was playing in this front yard here in east san jose. toys belonging to the children in the home are now gathered by the home's front door. the child's mother told police a stranger came up to where her daughter was playing and made a comment about the child. the comment made the mother uncomfortable. as she picked the girl up, the stranger grabbed the girl's legs and tried to pull the child away from her. after a short struggle with the man the mother managed to pull her child away and run into the house where she called police. the suspect ran down pavin drive after the ordeal. several police units responded and searched the area without success. he is described as a hispanic male, twenty to 30 years old red baseball cap, blue jeans a white or light t-shirt with

yellow stripes. the mother told police that the suspect smelled of motor oil. thousand, we talked to the folks off camera and the little girl is actually uninjured and now recovering. san jose police are asking anyone with information to give them a call. live in san jose, thomas roman, abc news. >> thank you. we are also following developing news in san jose where a broken streetlight may have been a factor in a crash involving a truck and two children on their bicycles. sky 7hd was on the scene moments after the east gate avenue. the children were both taken to the hospital and they are expected to be okay. the truck driver cooperated with police and was not charged. in oakland tonight the city is getting closer to high level help to fight violent crime. the first step was taken toward hiring a police consult at the present time with a -- consultant with a big time resume. alan wang is live with a marquis name in law

made an emergency landing in western japan after a cockpit message showed battery problems on the plane. it is the latest in a series of mishaps involving boeing's newest plane. that included fuel leaks and wiring problems. after six nights of freeze warnings we are going from very cold to rather crisp. now a live doppler 7hd update. >> let's look at live doppler 7hd. it is going to be chilly tonight, but not bone chilling cold as we have had the last few nights. 32 at fairfield. it is pretty chilly in the east bay and the north bay. 35 in napa and 35 in santa rosa. it is down to 30 at napa and 28 at fairfield. so once again it is going to be cold overnight, but not the cold we have had the last few nights with freeze warnings and frost advisories. we have milder days ahead which i will tell you about shortly. >> spencer, thanks very much. >> police have releasedded a picture of a man suspected it

of killing a dog during a robbery. they are on the lookout for loris barrett. her dog started barking from inside her car. police say he snatched the dog out of the car and threw it into on coming traffic. her 12-year-old dog red roxy died. there is a reward for anyone who tracks down barrett. a tom cat was hit with a 22-inch arrow while roaming in contra costa county. they found him injured yesterday and took him to the vet where he underwent emergency surgery. the vet says he is in good shape considering that an arrow made its way through his body. >> he hit -- he was very, very lucky it didn't hit his spine or his chest cavity. >> contra costa animal services took that arrow as evidence. if they can track down the shooter, that person would

likely face animal cruelty charges. two missing snowmobilers have been found alive in the snowy frigid forest. they were located near the reservoir on saturday four miles from their snowmobiles. they are being treated for hypothermia and frost bite. they went out on a day trip on friday, but they never returned home. the two most likely would not have survived a day in the cold. san francisco unified school district will receive a boost to its budget thanks to the rainy day fund. the mayor has released $1.5 million to help with this year's school budget. it is to access the $30 million account they need to match certain criteria such as facing significant teacher layoffs. they have taken $8 million from that account this school year. coming up next, the battle in washington over gun control. what president obama is expected to propose tomorrow. >> i think we have done in uh while.

connecticut school masacre president obama will unveil his plan to fight gun violence. one member on his side is san mateo democrat jackie spear who met with vice president biden yesterday. >> i think the president has made it clearan an assault weapon ban renewed. he wants a ban on magazines that are high capacity. and we absolutely have to have a universal criminal background check. >> that means guaranteed background checks when people buy weapons from gun shows or private sellers. >> why would we want to continue to have an environment that we do here in this country and not so much in california, but in the country our 40% of the guns purchased don't have a background check. >> the group responsible citizens of california sees the president's plan as an attack on the second amendment. >> the focus should be on the behaviors of the individual who chitted the crime. not focusing on the

individuals who have not committed crimes. and essentially what this does is it places us in the same bucket. >> the nra released a web video attacking the president because his children have armed security at school. >> mr. obama demands the wealthy pay their fair share of taxes. but he is just another elitist hipocrite. >> this comes on a day that new york passed the toughest gun control law in the nation intended to stop mentally ill patients from buying weapons. >> we must stop the madness. >> that was andrew cuomo. they are facing tough opposition from lawmakers. they say mr. obama is looking at 19 steps he could take using only executive orders. dan? >> thank you. marin county's gun buy back program has taken hundreds of guns out of north bay homes. authorities offered up to $200 in cash. the program was so popular it ran out of money in just an hour. that's $43,000.

officers collected827 guns which included a sawed off shotgun. facebook is even more personal with a launch today of a search engine that is taylor made for you. graft search works off a database from people voluntarily sharing their likes and dislikes. it is different from sites because it allows you to instantly survey the places and things they like. the new feature might lure back the 1.4 million people nationwide who closed their facebook accounts in early december alone. the social network is still 166 million people strong in the united states. >> the -- the internationally renouned maverick surf competition could take place this weekend. it could produce waves of more than 25 feet. organizers should know by friday or early saturday.

hill. as you can see it is going to be cold in the interior valleys. even chilly to cold around the bay shoreline with lows in the 30s as well. san francisco will be the mild spot with a low of 42 degrees. we had one cold air mass with the center of high pressure that shifted inland. there -- this will be a much milder air mass. skies will remain sunny for the next six or seven days with the milder afternoons we have seen of late. let's start with the south bay tomorrow under sunny skieses and the high temperatures will climb into the upper 50s at santa clara and san jose. 60 degrees tomorrow at campbell and saratoga. upper 50s and highs of 57 at san mateo and 60 at loss altos and mountain view. and on the coast, relatively mild. pacifica 54. downtown san francisco will have a high of 57 tomorrow. 55 in the sunset district and we will see milder conditions in the north bay as well.

look for highs of 57 in napa, sonoma and petaluma. 60 in santa rosa and 61 in cloverdale. on the east bay we will see high temperatures tomorrow up to 57 in berkeley and 58 in hayward and san leandro. 59 in oakland and castro valley, and 60 in fremont. the inland east bay, upper 50s for the most part, 58 at livermore and danville and walnut creek at 57 concord, dublin and pleasanton and near monterey bay, highs of 61 in watsonville and 60 in santa cruz and monterey. 62 in salinas. cooler inland at morgan hill and gilroy where the highs will reach only 59. here is the accu-weather seven-day forecast. here comes even milder weather. by friday we will see inland highs in the low 60s and mid60s around the bay. and up to 60 on the coast. that range of highs will stay with us through the weekend and into early next week. skies will remain sunny. just a few clouds on tuesday. no hint of sub freezing temperatures for awhile. >> thanks, spencer. 49er fever is getting

shumann will be covering the game for us. that starts on friday. the first owner of the san jose sharks died of cancer today. gund and his brother took a gamble that hockey would take on in northern california so they started the sharks as an expansion team in 1991. gund kind ofy eccentric. he built his own apartment into the arena. he had his own place. they had it for a decade before selling the sharks. he was 75 years old. in the australian open, they took the court and it looked like a routine second round match that turned into a struggle and a loss. with the fanatics cheering them on, this is a great rally right here. the lob and then the winner. but coming back from ankle surgery, he is up 5-2 and gets stunned.
